When is a Muslim ruler regarded as a disbeliever if he rules by other than Allah?
- It is Wajib for the muslim ruler to rule by Allah’s Shariah.
- If the muslim ruler is ignorant about ruling by the shariah, then dawah should be done, and the ruling depends on his answer.
- If a muslin ruler agrees that it is wajib to rule by the shariah and he agrees it is haram to rule by other than the shariah yet he rules by other than Allah’s Shariah then he is a fasiq (major sinner).
- If a muslim ruler tells that the constitution that they have written is equal/better than the shariah, or he says that the shariah is outdated and cannot be ruled by in our times then he is a disbeliever (kafir).
- If a muslim ruler believes that the shariah is supreme and he also believes that ruling by the shariah is wajib but he believes that ruling by other than the shariah is permissible then he is a kaafir.
- If a Muslim ruler wants to apply the shariah but he is forced by internal & external powers of his nation to not rule by Allah’s Shariah then he must try his best. If not possible, then he is exempted because of his incapacity.
