The Story of A Woman Interjecting And Correcting Umar (رضي الله عنه) On The Issue of Mahr Is Unauthentic!

One day Caliph Umar during the course of his sermon to the people, said: “If any one marries and fixes a mehr (dowry) for more than 400 dirhams for his wife, I will inflict the prescribed punishment on him and will deposit the excess amount in the Baitu’l-Mal (Public Treasury).”

A woman from the audience called out: “Umar! Is what you say more acceptable or Allah’s ordinance? Does not Allah Almighty say: ‘And if you wish to have (one) wife in place of another and you have given one of them a heap of gold, then take not from it anything.’” (4:20)

Having heard this verse and the retort of the woman, Umar said: “You have better knowledge of fiqh and problems than Umar, all of you, including even the women observing purdah sitting in their homes.”

Then Umar again mounted the pulpit and said: “Although I have forbidden you to give more than 400 dirhams as dowry to your wives, I now permit you to give as much as you like beyond the appointed limit. There is no harm in it.”

This hadith shows that Caliph Umar was not well versed in the Qur’an and jurisprudence. Otherwise, he would not have said something so obviously incorrect that he could be silenced by an informed woman

It was narrated that:
Abu Ajfa As-Sulami said: “Umar bin Khattab said: ‘Do not go to extremes with regard to the dowries of women, for if that were a sign of honor and dignity in this world or a sign of Taqwa before Allah, then Muhammad (ﷺ) would have done that before you. But he did not give any of his wives and none of his daughters were given more than twelve uqiyyah. A man may increase dowry until he feels resentment against her and says: “You cost me everything I own,” or, “You caused me a great deal of hardship.”’”

Abu Al-Ajfa (As-Salami) said:
“Umar bin Al-Khattab said: ‘Do not exaggerate in the dowries of women. If doing so was honorable in the world or Taqwa before Allah then Allah’s Prophet would have been the first of you to do it. I do not know of the Messenger of Allah marrying any of his women, nor giving any of his daughters in marriage, for more than twelve Uqiyah.”

Hadith 84:

Umar ibn Al-Khattab said, that the Prophet ﷺ said: Islam will be victorious (dominant) till the businessmen travel on the seas, and till horses gallop in the path of Allah, untill, a people appear who will recite The Quran and will say, “Who is the best reciter amongst us? Who is the most knowledgeable amongst us? Who is the best Faqeeh amongst us?”. Then he ﷺ said to his companions, “Will these people have any goodness?” The Sahaba said, “Allah and His Messenger know the best.” The Prophet ﷺ said: They will be from this Ummah and they will be the fuel of the hell fire.

Warning Against Unwanted Argumentation And Abandoning Arguing Even If One Is Upon The Haq.

Hadith 85:

It was narrated that Ans bin Malik said:
“The Messenger of Allah (ﷺ) said: ‘Whoever gives up telling lies in support of a false claim, a palace will be built for him in the outskirts of Paradise. Whoever gives up argument when he is in the right, a palace will be built from him in the middle (of Paradise). And whoever had good behavior, a palace will be built for him in the highest reaches (of Paradise).'”

Hadith 86:

Muadh bin Jabal said that the Messenger of Allah (ﷺ) said, “I guarantee a house in the surroundings of Jannah; and I guarantee a home in the middle of Jannah; and I guarantee a house in the highest part of Jannah: *for the one who gives up arguing, even if he is in the right;*for one who abandons lying even for the sake of fun;*for one who has good manners.

الْمِرَاءُ فِي الْقُرْآنِ كُفْرٌ ‏”‏ ‏.‏

The Prophet (ﷺ) said: Controverting (Unnecessary debate and argumentation) about the Qur’an is disbelief.

Allah’s Messenger (ﷺ) said, “The most hated person in the sight of Allah, is the most quarrelsome person.”

The Places Where It Is Prohibited To Answer The Call of Nature.

Hadith 89:

Ibn Abbas said that I heard the Messenger of Allah ﷺ say: Beware of the three things which make one accursed. It waa asked: What are the three things that make one cursed? He ﷺ said: (1) Answering the call of nature in places where shade is sought, (2) answering the call of nature on the pathways, (3) or near stagnant water.

Hadith 90:

On the authority of Abu Hurairah that the Messenger of Allah ﷺ said: Whoever doesn’t face the Qiblah or neither does he turn his back (to the Qiblah) when he is answering the call of nature, a good deed will be recorded for him, and a bad deed will be erased from him.

Warning Against Urinating In Standing Water, In A Bathroom, And A (Stray) Hole.

Hadith 91:

Bakr bin Maaiz said that he heard Abdullah bin Yazeed say on the authority of the Messenger of Allah ﷺ that he said:

“Do not urinate in a bowl in the house, for angels do not enter a house which has collected (stagnated) urine, and do not urinate in your bath houses.”

Hadith 92:

Humayd al-Himyari said: I met a man (Companion of the Prophet) who remained in the company of the Prophet (ﷺ) just as AbuHurayrah remained in his company. He then added: The Messenger of Allah (ﷺ) forbade that anyone amongst us should comb (his hair) every day or urinate in the place where he takes a bath.

Rebuking Taking Whilst Answering The Call of Nature.

Hadith 93:

Duas in Salah in Non-Arabic Languages.

الحمد لله و الصلاة و السلام على رسول الله و على آله و صحبه أجمعين…

1) There is no proof from the Prophet ﷺ whatsoever that personal Duas in the prayer are to be made only in the pure Arabic language.

2)`Amr bin Malik Al-Janbi narrated that he heard Fadalah bin `Ubaid saying:

“The Prophet (ﷺ) heard a man supplicating in his Salat but he did not send Salat upon the Prophet (ﷺ), so the Prophet (ﷺ) said: ‘This one has rushed.’ Then he called him and said to him, or to someone other than him: ‘When one of you performs Salat, then let him begin by expressing gratitude to Allah and praising Him. Then, let him send Salat upon the Prophet (ﷺ), then let him supplicate after that, whatever he wishes.’” (Sunan At-Tirmidhi 3477)

(Note: The Prophet ﷺ rectified the Sahabi while he erred in making a Dua, so it is unimaginable that he ﷺ left out reminding the Ummah about the importance of the Arabic language in Dua.)

3)It was narrated from Abu Hurairah that:

The Messenger of Allah (ﷺ) said: “The closest that a person can be to his Lord, the Mighty and Sublime, is when he is prostrating, so increase in supplication then. Sunan An-Nasai 1137.

4) Jubair bin Nufair narrated that `Ubadah bin As-Samit narrated to them that, the Messenger of Allah (ﷺ) said:

“There is not a Muslim upon the earth who calls upon Allah with any supplication, except that Allah grants it to him, or he turns away from him the like of it in evil; as long as he does not supplicate for something sinful, or the severing of the ties of kinship.” So a man from the people said: “What if we should increase (in it)” He (ﷺ) said: “(With) Allah is more.” (Sunan At-Tirmidhi 3573.)

(Note: There is no mention of Arabic being a condition in both the Ahadith above.)

5) Allah said in The Quran in many places that He doesn’t burden a soul (during worship) with more that it can bear. -This is a proof that it is not obligatory to stick to Arabic or compose Duas in Arabic for people who do not know Arabic.

6) The Prophet ﷺ and his Sahaba were aware and had people who accepted Islam and spoke non-Arabic languages, yet this didn’t make the Prophet ﷺ prohibit Dua in other than Arabic.

Proof that the Sahaba knew and were aware of Non-Arabic tongues.

7) As a summary: Supplications in the pillars and obligatory aspects of Salah (prayers) are to be done in Arabic. For the Sunnah aspects and Duas of prayers, we can do Dua in non- Arabic languages. It is safer to keep the Fard prayers free of any non-Arabic words to stay safe from scholarly differences. We may use Nawafil or Mustahab (non-obligatory) prayers for Duas in our own languages to stay safe.

8) This is an issue subject to scholarly dispute.

Shaykh al-Islam Ibn Taymiyah said:

It is permissible to make du’aa’ in Arabic and in languages other than Arabic. Allaah knows the intention of the supplicant and what he wants, no matter what language he speaks, because He hears all the voices in all different languages, asking for all kinds of needs.

The Child of Fornication is the worst of the three- Understanding The Hadith.

Q) How should we understand the following Hadith and the statement (Athar) of Abu Hurairah (رضي الله عنه)?

Narrated AbuHurayrah:

The Prophet (ﷺ) said: The child of adultery is worst of the three.

Abu Hurairah said: That I give a flog in the path of Allah (as a charity) is dearer to me than emancipating a child of adultery.

حَدَّثَنَا إِبْرَاهِيمُ بْنُ مُوسَى، أَخْبَرَنَا جَرِيرٌ، عَنْ سُهَيْلِ بْنِ أَبِي صَالِحٍ، عَنْ أَبِيهِ، عَنْ أَبِي هُرَيْرَةَ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ “‏ وَلَدُ الزِّنَا شَرُّ الثَّلاَثَةِ ‏”‏ ‏.‏ وَقَالَ أَبُو هُرَيْرَةَ لأَنْ أُمَتِّعَ بِسَوْطٍ فِي سَبِيلِ اللَّهِ عَزَّ وَجَلَّ أَحَبُّ إِلَىَّ مِنْ أَنْ أَعْتِقَ وَلَدَ زِنْيَةٍ ‏.‏

Sahih (Shaikh Al-Albani, Shaikh Muqbil bin Hadi), Sunan Abi Dawud 3963.

Answer:

The Hadith is Sahih, but what completes its meaning is the narration of Ummi (our mother) Aisha (رضي الله عنها).

  • [عن عائشة أم المؤمنين:] أنَّ عائِشَةَ رضِيَ اللهُ عنها كانت إذا قيلَ لها: هو شَرُّ الثَّلاثَةِ (يَعني وَلَدَ الزِّنا)،عابَتْ ذلك وقالت: ما عليه مِن وِزرِ أَبَوَيْه، قال اللهُ: {وَلا تَزِرُ وازِرَةٌ وِزْرَ أُخْرى} [الإسراء: ١٥].
  • شعيب الأرنؤوط (١٤٣٨ هـ)، تخريج المسند ١٣/٤٦٣ • سنده صحيح. • أخرجه عبدالرزاق (١٣٨٦٠) واللفظ له، وابن أبي شيبة (١٢٦٨٣)، والحاكم (٧٠٥٣)

On the authority of Aisha Ummul Mumineen: When it was mentioned to Aisha that- ‘He is the worst of the three (i.e. the child of fornication)’, she rejected it (i.e. she rejected the apparent meaning of the Hadith related by Abu Hurairah strongly) and said, ‘Not upon him (the illegitimate child) is the sin of his parents’. Allah said ‘and no bearer of burdens shall bear the burden of another’. [al-An’aam 6:164]

The meaning of Hadith as understood by Imam Sufyan Ath-Thawri (97 AH-161 AH), who was from the senior students of the students of the Sahaba (Lower level Tabai or Atba-Tabai) is-

  • ولَدُ الزِّنا شَرُّ الثلاثَةِ إذا عمِلَ بعمَلِ أبوَيهِ
  • البيهقي (٤٥٨ هـ)، السنن الصغير للبيهقي ٤/١٠٥ • قوله: (إذا عمل بعمل أبويه) المحفوظ أنه من قول سفيان الثوري.

(Sufyan At-Thawri said:) “The child of fornication is worst of the three (i.e. his fornicating parents and himself) if his action is like the action of his parents.”

The portion ‘if his action is like the action of his parents’ is the interpretation of the Hadith as stated by Imam Sufyan Ath-Thawri, and it is a preserved (authentic) statement from him. There are also many Daeef (weak) narrations similar to what Imam Sufyan Ath-Thawri said, but we will not use them as they are weak.

About the statement of Abu Hurairah:

Perhaps Abu Hurairah (رضي الله عنه) acted upon the apparent meaning of the Hadith, without considering or not recieving what Ummul Mumineen Aisha said. Abu Hurairah was a Mujtahid Aalim he acted upon what he recieved, he will be rewarded singly even if he was mistaken in his Ijtehad to follow the truth.

We also understand that Ahadith are to be understood using the entirety of the texts (Quran and Sunnah) as understood by Aisha (رضي الله عنها).

What if someone says that what Abu Hurairah says is more authentic and that this means that he will not free a child of fornication from slavery. -Such a person is entitled to his opinion, if he is convinced of it to be the truth, he will also be rewarded based on his sincerity.

As a summary:
Hence Shaykh al-Islam Ibn Taymiyah (may Allaah have mercy on him) said:

“If an illegitimate child believes and does righteous deeds, he will enter Paradise, otherwise he will be punished for his deeds just like anyone else. The punishment is for the deeds, not for the lineage. Rather the illegitimate child is condemned because he is expected to do evil deeds, as often happens. By the same token, good lineages are regarded as praiseworthy because such people are expected to do good deeds. But when a person does a deed, then the reward or punishment is based on that, and the most noble of people before Allaah are those who are most pious. (al-Fataawa al-Kubra, 5/83).

Honouring the scholars, virtue of honouring them, and warning against insulting and dishonouring them.

Hadith 62:

Narrated Jabir bin `Abdullah:

Allah’s Messenger (ﷺ) shrouded every two martyrs of Uhud in one piece of cloth and then he would ask, “Which of them knew more Qur’an?” When one of them was pointed out he would put him first in the grave***. He said, “I am a witness on these.” Then he ordered them to be buried with blood on their bodies. Neither did he offer their funeral prayer nor did he get them washed. (Jabir bin `Abdullah added): Allah’s Messenger (ﷺ) used to ask about the martyrs of Uhud as to which of them knew more of the Qur’an.” And when one of them was pointed out as having more of it he would put him first in the grave and then his companions. (Jabir added): My father and my uncle were shrouded in one sheet.

Hadith 63:

Narrated AbuMusa al-Ash’ari:
The Prophet (ﷺ) said: Glorifying Allah involves showing honour to a grey-haired Muslim and to one who can expound the Qur’an, but not to one who acts extravagantly regarding it, or turns away from it, and showing honour to a just ruler.

Hadith 64:

On the authority of Ibn Abbas, that indeed the Messenger of Allah ﷺ said: Al-Barakah is with your seniors.

Hadith 65:

On the authority of Abdullah ibn Amr that it was conveyed to us by the Prophet ﷺ that: He is not one of us who doesn’t have mercy upon our young ones and knows the rights of our elders.

Hadith 66:

On the authority of Ubadah bin As-Samit that verily the Messenger of Allah ﷺ said: He is not from my Ummah who doesn’t- honour our elders and shows mercy upon our young ones, and (doesn’t) know the rights of our scholar.

Warning against seeking knowledge for other than pleasing Allah.

Hadith 67:

Narrated Abu Hurayrah:

The Prophet (ﷺ) said: If anyone acquires knowledge that should be sought seeking the Face of Allah, but he acquires it only to get some worldly advantage, he will not experience the arf, i.e. the fragrance, of Paradise.

Ka’b ibn Malik reported: The Prophet, peace and blessings be upon him, said, “Whoever seeks knowledge to impress the scholars, to argue with the foolish, or to attract the attention of people, Allah will admit him into Hellfire.”

Abu Hurairah (May Allah be pleased with him) reported:
The Messenger of Allah (ﷺ) said, “When a man dies, his deeds come to an end, except for three: A continuous charity, knowledge by which people derive benefit, pious son who prays for him.”

Hadith 72:

It has been narrated on the authority of Abu Mas’ud al-Ansari who said:
A man came to the Messenger of Allah (ﷺ) and said: My riding beast has been killed, so give me some animal to ride upon. He (the Holy Prophet) said: I have none with me. A man said: Messenger of Allah, I can guide him to one who will provide him with a riding beast. The Messenger of Allah (ﷺ) said: One who guides to something good has a reward similar to that of its doer.

Hadith 73:

Abu Huraira reported Allah’s Messenger (ﷺ) as saying:
He who called (people) to righteousness, there would be reward (assured) for him like the rewards of those who adhered to it, without their rewards being diminished in any respect. And he who called (people) to error, he shall have to carry (the burden) of its sin, like those who committed it, without their sins being diminished in any respect.

عن عليٍّ رَضِيَ اللهُ عنه في قولِه تعالى: {قُواأَنْفُسَكُمْ وَأَهْلِيكُمْ نارًا} [التحريم: ٦]، قال: عَلِّمُواأهليكمُ الخيرَ
On the authority of ‘Ali (رضي الله عنه) that he said about the statement of Allah: {Save yourselves and your familes from the hell fire}. He said: Teach your families Al-Khair (The Quran and Sunnah).

Warninh People Who Hide Knowledge
Hadith 75:
Narrated AbuHurayrah:
The Prophet (ﷺ) said: He who is asked something he knows and conceals it will have a bridle of fire put on him on the Day of Resurrection.

Hadith 76:

On the authority of Abu Hurairah that the Messenger of Allah ﷺ said: The similitude of the one who has learnt knowledge but does not spread it, is like that of a person who has gathered great wealth but does not spend from it.

Not Acting Upon One’s Knowledge And Acting Differently From What One is Preaching.

Hadith 77:
Zaid bin Arqam said that the Prophet ﷺ used to say:
اللَّهُمَّ إنِّي أَعُوذُ بكَ مِن عِلْمٍ لا يَنْفَعُ، وَمِنْ قَلْبٍ لايَخْشَعُ، وَمِنْ نَفْسٍ لا تَشْبَعُ، وَمِنْ دَعْوَةٍ لا يُسْتَجابُ لَها.
The entire Hadith:
Zaid b. Arqam reported:
I am not going to say anything but only that which Allah’s Messenger (may peace be upgn him) used to say. He used to supplicate:” O Allah, I seek refuge in Thee from incapacity, from sloth, from cowardice, from miserliness, decrepitude and from torment of the grave. O Allah, grant to my soul the sense of righteousness and purify it, for Thou art the Best Purifier thereof. Thou art the Protecting Friend thereof, and Guardian thereof. O Allah, I seek refuge in Thee from the knowledge which does
not benefit, from the heart that does not entertain the fear (of Allah), from the soul that does not feel contented and the supplication that is not responded.”

Hadith 78:
Usama bin Zaid said, “I have heard the Prophet ﷺ saying, “A man will be brought on the Day of Resurrection and thrown in the (Hell) Fire, so that his intestines will come out, and he will go around like a donkey goes around a millstone. The people of (Hell) Fire will gather around him and say: O so-and-so! What is wrong with you? Didn’t you use to order us to do good deeds and forbid us to do bad deeds? He will reply: Yes, I used to order you to do good deeds, but I did not do them myself, and I used to forbid you to do bad deeds, yet I used to do them myself.” (Part of Sahih Al-Bukhari 3267, Sahih Muslim 2989)
Hadith 79:
The Messenger (sallAllahu ‘alaihi wasallam) also said in a hadith, “During the night of my ascension, I passed by a group of people. Their lips were being severed with scissors of fire. I said, “O Jibreel (alaihis salam)! Who are these people?” He said, “They are the preachers from your Ummah that would say other than what they would do”. (Reported by Ahmad in his Musnad, 3/120, 231, and 239; Ibn Hibban and others.)

And in another narration: ‘These are those people who read the Book of Allah but do not act upon it.’ (Ibn Abi Ad-Dunya, Al-Bayhaqi in Shuaib Al-Iman 773, Sahih)
Hadith 81:
Ibn Mas’ud narrated that the Messenger of Allah (s.a.w) said:
“The feet of the son of Adam shall not move from before his Lord on the Day of Judgement, until he is asked about five things: about his life and what he did with it, about his youth and what he wore it out in, about his wealth and how he earned it and spent it upon, and what he did with what he knew.”

Hadith 82:
On the authority of Luqman- i.e. Ibn ‘Aamir- who said: Abu Darda would say, “Indeed I fear from my Lord that He will call me on the Day of Judgement from amongst the heads of the creation and will say to me: Oh Uwaymir! I will say: In you presence O Lord! He (Allah) will say: How much did you act upon what you had learnt?”.

Hadith 83:

Jundub bin Abdullah Al-Azdi, the companion of the Prophet, narrated that the Messenger of Allah ﷺ said:

The example of the one who teaches the people Al-Khair (Goodness, beneficial knowledge) and forgets himself, is like a lamp, which spread light to the people but burns itself.
